In this case, the petitioner is seeking anticipatory bail in connection with Barbigha (Mission O.P.) P.S. Case No.280 of 2018, registered for the offence under Sections 341, 323, 354, 504, 506/34 of the Indian Penal Code and Section 37 (c) of the Bihar Excise Act, 2016.

As per the FIR, four persons, after taking wine, have entered into the house of the informant. When they were prevented, then the accused persons started hurling abuses in the name of her husband of the informant. When the husband of the informant came, they assaulted him including his son and also tried to outrage the modesty of the informant. It has also been alleged that the informant has made a video of the incident.

No.3464 of 2019(3) dt.20-02-2019 2/2 From a perusal of paragraph nos. 5, 6, 7, 30, 35, 41, 44, 53 of the case diary, it appears that the petitioner is involved in the crime and the Police has also arrived to an opinion that the persons, after taking wine, ransacked the house of the informant and also misbehaved with her.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
