JUSTICE SHIVAJI PANDEY ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. In this case, the petitioner is seeking regular bail in connection with Ahiyapur P.S. Case No. 147 of 2020/ N.D.P.S. Case No. 8 of 2020 registered for offence punishable under section 414/34 of the Indian Penal Code and sections 20/22 of the Narcotic Drugs and psychotropic Substances Act. One kilogram Ganja has been recovered from the possession of the petitioner.
Earlier the petitioner had moved before this Court for grant of regular bail in Cr. Misc. 21162 of 2020 and this Court, vide order dated 07.07.2020, rejected the bail of the petitioner. Learned counsel for the petitioner submits that the petitioner is in judicial custody since 07.02.2020. Looking to the period of custody, let the petitioner
Patna High Court CR. MISC. No.13525 of 2021(2) dt.07-04-2021 2/2 above named be released on regular bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 8th Additional Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 147 of 2020/ N.D.P.S. Case No. 8 of 2020, subject to the condition that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the court below will take decision in accordance with law.
