The petitioners seek bail in Chakiya P.S. Case No. 41/10, under Section 386 Indian Penal Code and 3/4 Explosive Substance Act.
The informant alleged that some criminals came to
Patna High Court Cr.Misc. No.45242 of 2014 (2) dt.03-03-2015 his mobile shop and exploded bombs. Earlier, ransom was demanded. The First Information Report is instituted against unknown.
Learned Counsel for the petitioners submits that from perusal of the record it appears that name of Raza Singh @ Raj Kumar Shahni figured in the supervising note of SDPO, and the name of Devendra Kumar Singh appeared in the case in confessional statement of one Bablu, in para 62 of the case diary. Thereafter, supervising authority named the petitioner Devendra Kumar Singh in supervision note, but it appears that the investigating officer did not get any tangible evidence to show the involvement of the petitioner. Co-accused has already been enlarged on bail.
Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Chakiya P.S. Case No. 41/10.
