JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report on the accusation that they along with others pushed an old wall which fell on the informant and his father, as a result of which informant's father died. Petitioner is in jail custody for the aforesaid offence since 02.12.2015 and submission on behalf of the petitioners is that there was partition dispute between the parties and that is the reason, the informant lodged this false case against the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above

Patna High Court Cr.Misc. No.4797 of 2016 (2) dt.11-02-2016 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar ( Town) P.S.Case No. 429 of 2015.
