The petitioners apprehend their arrest in connection with Rajeev Nagar P.S. Case No.17 of 2015 for the offences punishable under Sections 147, 149, 341, 341, 342, 447, 448, 324, 384, 354,308 and 504 of Indian Penal Code.
Having heard learned counsel for the parties and taking note of the specific allegation made against petitioner No.1 namely Manoj Rai @ Manoj Kumar, I am not persuaded to grant indulgence to his prayer for anticipatory bail and this application in so far as Manoj Rai @ Manoj Kumar is concerned, stands disposed of with a direction to him to surrender
Patna High Court Cr.Misc. No.4860 of 2016 (2) dt.16-03-2016 2/2 and pray for regular bail which should be considered by the court below on its own merits and disposed of in accordance with law without being prejudiced by the present order. In so far as the petitioner Nos. 2 to 4 is concerned, considering the omnibus nature of allegation against these petitioners, let these petitioners namely Sanoj Rai @ Sanoj Kumar, Asarfi Rai and Shrinath Rai in the event of their arrest/surrender within four weeks from today, be released on bail upon furnishing individual bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Rajeev Nagar P.S. Case No. 17 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure. This application is allowed in part.
