JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Petitioner is languishing in custody since 05.04.2014 in a case registered for the offences punishable under Sections 384, 386, 387/34 of the I.P.C. On information that miscreants have assembled to demand extortion, raid was laid leading to arrest of co-accused Sanjay Kumar and Baikunth Kumar. The name of the petitioner sprang up on confession of the apprehended accused.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and the investigation has already concluded. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
Patna High Court Cr.Misc. No.13905 of 2015 (2) dt.10-04-2015 2/2 Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 07 of 2014.
Since the petitioner has serious criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
