The petitioner seeks bail in a case registered for the offences punishable under Sections 392 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 12.06.2020, is a person with clean antecedent and charge-sheet has been submitted in the case. The informant who is a manager of Saksham Life Company alleges that on 03.09.2019, he dispatched 100 cartons of Dispo Van loaded on a pickup van to Govind Mitra Road, Patna, it is next alleged that as the vehicle reached near Mahua Road, some miscreants looted the said vehicle with loaded goods, accordingly the driver of vehicle informed the informant

No.2934 of 2022(2) dt.25-05-2022 2/3 and the informant accordingly informed the police, further with the help of GPS system installed in the pickup van, the police reached the house of Shankar Rai where the alleged vehicle was found parked but only with 63 cartons of Dispo Van and Shankar Rai confessed that his grandson, Ajit Kumar (petitioner) had brought the alleged pickup van. Learned counsel for the petitioner submits that the name of this petitioner came in the confessional statement of his grandfather with whom he is on litigating term with respect to property and thus he has been falsely implicated in the present case. It is further submitted that the petitioner has remained in custody for nearly two years and is a person with clean antecedent.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 12.06.2020, is a person with clean antecedent, chargesheet has been submitted in the case and it is his first offence, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in
