1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Kateya Police Station Case No. 269 of 2022, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, on 21.06.2022, during the course of vehicle check, the informant intercepted one motorcycle which was coming from U.P. side, however, upon chase, police apprehended the person who was driving the motorcycle and seized the motorcycle. The arrested person disclosed his name as Md. Imran Ali. The police recovered 375ml foreign liquor from the dikki of the motorcycle having Reg. No. UP57AA-1339.

4. Learned Counsel for the petitioner submits that the petitioner has been made accused merely on the basis of the fact that he happens to be the registered owner of the motorcycle. The motorcycle in question was borrowed by the co-accused Md. Imran Ali for some urgent work and the petitioner was not aware that illicit liquor was being carried on his motorcycle. The petitioner is having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner and he is having no criminal antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeXIII-cum-Special Excise Court No. 1, Gopalganj, in connection with Kateya Police Station Case No. 269 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

8. One of the bailor of the petitioner shall be a local person.
