JUSTICE SUDHIR SINGH ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 12.02.2016 in connection with Muffassil P.S. Case No. 70 of 2016 for the offences instituted under Sections 406, 420, 467, 468 and 471 of the IPC.

The prosecution story, in brief, is that in the year 2011, this petitioner came at the house of the informant disclosing that he is an agent. He demanded Rs. 6,00,000/- after giving assurance that she will get Rs. 40,00,000/- after 13 years. He took the money and when she raised suspicion then she demanded money, but he has not returned the same.

It has been submitted on behalf of the petitioner that the

There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. As per prosecution case, in the year 2011, the informant claims to have given Rs. 6,00,000/- on assurance that she will get back Rs. 40,00,000/- after 13 years. There is no chit of paper to show that the informant had given any money to the petitioner. The petitioner has falsely been implicated in the present case.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Mufassil P.S.
