The petitioner seeks regular bail in a case under Section 302 and other sections of the Indian Penal Code. Hira Kumar Singh, the informant, named the petitioner along with Suraj Singh @ Munne Ji, Niraj Singh @ Nanhe Ji and Banti Singh and alleged that Suraj Singh @ Munne Ji firstly assaulted the informant with the back portion of Dabiya on his right hand. Ranjit Singh exhorted Suraj Singh @ Munne Ji and, on such, Suraj Singh @ Munne Ji gave two blows on the head of Phuleshwar Singh, who died during the course of treatment. Learned counsel for the petitioner submits that the petitioner is the order giver. From the side of the petitioner, Beldaur P.S. Case No. 80/2014 is registered against the deceased

Patna High Court Cr.Misc. No.8156 of 2015 (2) dt.02-03-2015 2/2 and others. There is a land dispute between the parties. Other two accused persons are alleged to have assaulted the deceased but from perusal of the post mortem report, it appears that the deceased Phuleshwar Singh got two injuries on his head and the third injury is bruise. The injuries found on the head of Phuleshwar Singh are said to have been caused by Suraj Singh @ Munne Ji. The petitioner is in jail since 28.11.2014. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagariya in Beldaur P.S.
