The petitioner seeks regular bail in connection with Siwaipatti P.S. Case No. 90 of 2021 lodged under Sections 467, 471, 420 and 414 of the Indian Penal Code, 1860. As per the allegation made in the F.I.R., the specific allegation against the petitioner is that one motorcycle was recovered from the petitioner. There are sixteen named accused in this case and petitioner is alleged to be one of them. Learned counsel for the petitioner submits that petitioner is a poor person and he is surviving his livelihood by running Bhuja, Eggs and Chaumin shop at Hanuman Nagar Chowk. At about 3.30 pm he was on shop, Siwaipatti police visited there and one customer standing with motorcycle all of a

Police is arrested the petitioner on suspicion. He further submits that charge sheet has already been filed in this case and petitioner is in custody since 03.08.2021. He also submits that petitioner has no criminal antecedent.
Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of records as well as this aspect that charge sheet has already been submitted and petitioner is in custody since 03.08.2021 having clean antecedent, let the petitioner above named, be granted bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.Ist Class, Muzaffarpur in connection with Siwaipatti P.S. Case No. 90 of 2021.
