Case no. 31/2014 registered under sections 363, 364, 366A, 376 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Patna High Court Cr.Misc. No.15492 of 2015 (3) dt.10-09-2015 The statement of victim has been recorded under section 164 of the Cr.P.C. Although she has stated in her statement that she was kidnapped by the petitioners but she admitted in her statement that after three days of alleged occurrence, she was dropped by the petitioners near canal of her village.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above stated petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Salkhua P.S.
