2. The petitioner seeks regular bail in connection with Majorganj P.S. Case No. 77 of 2022, lodged on 06.04.2022 under Sections 304 (B), 34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against 4 named accused persons including the present petitioner. From the FIR, it transpires that the petitioner and other co-accused persons are said to have tortured the sister of the informant physically and mentally for non-fulfillment of demand of additional dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

Patna High Court CR. MISC. No.9517 of 2024(2) dt.20-02-2024 2/2 also submits that the antecedent of the petitioner is clean and he is in custody since 19.04.2023. Counsel further submits that other co-accused persons have been granted bail by the coordinate bench of this Court vide orders dated 19.06.2023 and 29.08.2023 passed in Cr. Misc. Nos. 64943 of 2022 and 55668 of 2023 respectively.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Majorganj P.S. Case No. 77 of 2022, pending before the learned 1st Additional Chief Judicial Magistrate, Sitamarhi is hereby rejected.

8. Liberty is hereby granted to the petitioner that he may renew his prayer for bail nine months after framing of charge.
