JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The accusation against the petitioners and oher accused is that they mercilessly beaten the informant's son and also threw him in a pond.

Annexure-2 to this petition reveals that the informant's son sustained altogether four injuries and out of the said injuries, one injury which was on parital region of the scalp, was found grievous in nature as after X-ray, a hairline fracture was detected.

The contention on behalf of the petitioners is that in

Patna High Court Cr.Misc. No.9873 of 2015 (2) dt.12-03-2015 2/2 course of investigation, the informant in his further statement specifically, stated that it was co-accused Santosh Keshri, who gave blow on the scalp of the informant though the injured has not stated regarding the specific overt act against the petitioners and other accused.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Chainpur P.S. Case No. 163 of 2014 to the satisfaction of Chief Judicial Magistrate, Bhabhua (Kaimur). (Hemant Kumar Srivastava, J) A.K.V./- U T
