The petitioner seeks bail in connection with Phulpras P.S. Case No. 284 of 2014 for the offences punishable under sections 147, 148, 149, 302 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case, in brief, as per the written report of Hari Shankar Pandey, is that the petitioner and four others came armed with lathi, farsa and three Natta and on the order of Budur Kamat, Ram Pravesh Yadav fired with his three Natta at his son Nitish Kumar, who subsequently succumbed to his injuries.

No.16436 of 2015 (2) dt.10-06-2015 2 / 2 It has been submitted on behalf of the petitioner that the main allegation of assault upon the deceased is against Ram Pravesh Yadav. As far as the petitioner is concerned, he is said to be the member of the unlawful assembly. No overt act has been alleged against the petitioner nor any injury has been attributed to him.

It is further submitted that the petitioner has no criminal antecedent and he is in jail since 11-11-2014. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner Suraj Thakur be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani, in connection with Phulpras P.S. Case No. 284 of 2014.
