The petitioner seeks bail in anticipation of his arrest in connection with Excise P.S. Case No. 234C3Ex./2018 dated 12.12.2018 instituted for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
It appears that 21 litres of liquour has been recovered from the house of one Rajeev Kumar who was arrested and who has confessed about the participation of the petitioner also in the said offence. The petitioner
Patna High Court Cr.Misc. No.3880 of 2019(2) dt.28-01-2019 2/2 submits that nothing has been recovered from his possession or his constructive possession and he has a fair antecedent.
For the aforestated facts and circumstances, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District & Sessions Judge-cum-Special Judge (Excise), Nalanda at Biharsharif in connection with Excise P.S. Case No. 234C3Ex./2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
