JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner seeks bail in connection with Kashichak (Shahpur O.P.) P.S. Case No. 36 of 2015 registered for the offence punishable under Section 379 of the Indian Penal Code. The petitioner is not named in the first information report and he has been remanded in this case from Ghoshi (Okari ) P.S. Case No. 102 of 2015.

Submission is that the petitioner has been granted bail in Ghoshi (Okari ) P.S. Case No. 102 of 2015 and similarly situated co-accused Rahul Kumar has been allowed bail vide Cr. Misc. No. 56795 of 2015 and further Arjun Kumar has also been allowed bail and as such the petitioner who is suffering in custody since 23.11.2015 deserves sympathetic consideration to which learned APP does not dispute.

No.6748 of 2016 (2) dt.29-02-2016 In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Kashichak (Shahpur O. P.) P.S. Case No. 36 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
