JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One Tata Sumo vehicle and one motorcycle were recovered in front of house of the petitioner when informant and other police officials raided the house of the petitioner having got information that some criminals had come at the house of the petitioner. Moreover, no firearm was recovered from possession of the petitioner and it is stated that he was caught by the informant when he was sitting in the seized vehicle along with other accused. Contention on behalf of the petitioner is that the aforesaid recovery has not been made from conscious possession of the petitioner and as a matter of fact, petitioner does not have any concern with the seized vehicles.

No.5352 of 2016 (2) dt.15-02-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Naugachia in connection with Parbatta P.S. Case No. 15 of 2015.
