The petitioner is languishing in custody since 01.11.2018 in a case registered for the offences punishable under Sections 399, 402, 413, 414, 420 and 120(B) of the Indian Penal Code and 25(1-b)a and 35 of the Arms Act, 1959. The prosecution case is that on secret information that a large no. of motorcycle thieves are preparing to commit dacoity in Janki Nagar Market, a raid was laid and several persons were apprehended and from the possession of petitioner, a country made loaded pistol was recovered.

It is submitted by learned counsel for the petitioner that in fact the petitioner has falsely been roped in the present case. A statement has been made in paragraph no. 3 of the petition that

Considering the nature of recovery and period under custody, coupled with statement made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent , let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Basantpur, P.S. Case No. 376 of 2018.
