JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition & Excise Act.

As per the prosecution case, 2.340 liters of illicit liquor has been recovered from the house of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery rather the recovery is made from house which is in joint possession of family. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.3343 of 2022(2) dt.01-07-2022 2/2 prayer for anticipatory bail.

Considering the fact that recovery of liquor has been made from the house of this petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
