====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2024 Heard learned counsel for the petitioners and learned APP for the State.

2.The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition & Excise Amendment Act.

3. The learned cousnel for the petitioners submits that the petitioners are persons with clean antecedent and the allegation is of recovery of 285 liters of liquor from bank of river Bagmati.

4. The learned counsel for the petitioners submits that the petitioners were not arrested from the spot as such nothing

The alleged recovery is made from an open place which is accessible to public at large and the petitioner came to be implicated at the instance of local people but the name of local people, who disclosed the name of the petitioners, is not mentioned in the FIR which cast aspersion of the case of the prosecution.

5. Learned A.P.P opposes the bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs,. 5,000/- ( Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Exicse, Sheohar in connection with Purnahiya P.S.Case NO. 123 of 2023, subject to the conditions laid down under section 438(2) of the Cr. P.C.
