Petitioners, who are in custody seek bail in a case registered under Sections 30(a) 30(d) of Bihar Prohibition and Excise Act, 2016.
Informant who is the police officer has alleged in his written complaint that he received an information while on patrolling duty that in the house of Ranjit Paswan illicit liquor is being prepared and thereafter he raided his house where he saw one male and two female mixing something in Gallon who tried to flee away upon seeing the police and thereafter 15 litres of liquid material alleged to be used for preparation of illicit liquor
Patna High Court CR. MISC. No.1840 of 2020(2) dt.14-01-2020 2/3 was seized.
It has been submitted on behalf of petitioners that petitioners are innocent and have been falsely implicated in this case. No incriminating material in order to constitute any offence under the excise act has been recovered or seized from their house. Petitioners have no criminal antecedents and are in custody since 17.11.2019.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court below, in connection with Bachhwara P.S. Case No. 216 of 2019 subject to the conditions that:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioners shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move
Patna High Court CR. MISC. No.1840 of 2020(2) dt.14-01-2020 3/3 for cancellation of bail of the petitioners.
(4) If the petitioners are found involved in similar nature of offences, after their release on bail the trial court shall take steps to cancel his bail bond.
