JUSTICE AMARESH KUMAR LAL ORAL ORDER 01-06-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks bail in Pirpainti P.S. Case No.88 of 2014 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code.

The allegation against the petitioner is to have kidnapped the sixteen years old minor daughter of the informant for illegal purpose.

It is submitted that the petitioner has committed no offence. The victim girl has been examined by the doctor. The doctor has assessed her age between 17-19 years and he has not found any evidence of recent sexual intercourse.

The learned counsel for the State submits that it appears from the paragraph 50 of the case diary that the statement of the

No.14412 of 2015 (3) dt.01-06-2015 2/2 victim girl under Section 164 Cr.P.C. was recorded, in which, she has stated that the petitioner enticed her away from her house and she was taken to Mumbai where the petitioner kept her for 10-11 days and in that course, he committed rape upon her.

Considering the facts and circumstances of the case, in my opinion, the petitioner does not deserve bail at this stage. His prayer is rejected.

Let the trial be expedited.
