JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner is languishing in jail custody since 13.06.2014 in Deoriya P.S.Case No. 57 of 2014 on the accusation that 750 gms Charas was recovered from his possession. Learned counsel for the petitioner submits that even if it assumed that 750 gms Charas was recovered from the possession of the petitioner, then also, the aforesaid quantity is less than commercial quantity and moreover, according to prosecution case itself, three persons had brought the aforesaid Charas.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.12471 of 2015 (2) dt.27-03-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sessions Judge, Muzaffarpur in connection with Deoriya P.S.Case No. 57 of 2014.
