The petitioners are languishing in custody since 22.11.2014 in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120B, 504, 506/34 of the Indian Penal Code and 66/67 of I.T. Act.

It is alleged that petitioner no. 1 received cash of Rs.1,10,000/- and Rs.40,000/- was transferred in his account for providing employment but neither employment was provided nor the money was returned.

It is submitted by learned counsel for the petitioners that there is no proof with regard to cash payment

Patna High Court Cr.Misc. No.6873 of 2015 (03) dt.23-03-2015 2/2 whereas Rs.40,000/- was transferred in favour of petitioner no. 1 by Shivendra Ram, who is the son of the tenant of petitioner no. 1, hence, it is claimed that it is rental amount. Though, petitioner no. 1 is ready to Rs.40,000/- before the learned court below which will be invested in some Fixed Deposit Scheme in connection with the present case which will be subject to the result of the case. There is no specific accusation against petitioner no. 2. On deposit of Rs.40,000/- by petitioner no. 1, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Gardanibagh P.S. Case No. 335 of 2014.
