Mr.Atul Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-04-2023 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and Section 27 of Arms Act. As per prosecution case, while the informant was returning from Raghubansh Nagar to his house, in the meantime, the accused persons including the petitioner surrounded and snatched a silver chain, a mobile as well as his motorcycle. It is further alleged that they also fired by pistol upon him.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is not named

Patna High Court CR. MISC. No.5072 of 2023(2) dt.06-04-2023 2/2 in FIR rather he has falsely been made accused in this case. The name of the petitioner has transpired in this case on his self confessional statement in Bargama P.S. Case No. 110 of 2022 and thereafter he was remanded in the present case. It is further submitted that the petitioner has not put on TI Parade till date. Moreover the petitioner is languishing in judicial custody since 26.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barhara (Raghubansh Nagar) P.S. Case No. 205 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea.
