The petitioner seeks regular bail in connection with Ujiyarpur P.S. Case No. 175 of 2018 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 325, 341, 504 and 506 of the Indian Penal Code.
The allegation is regarding the accused persons having assaulted the informant and as far as the petitioner is concerned, he is said to have given a farsa blow on the head of the informant.
The learned counsel for the petitioner, referring to paragraph no. 7 of the bail petition, has submitted that the injury report shows that all the injuries are simple in nature, hence the petitioner did not have any intention to kill the informant, as
Patna High Court Cr.Misc. No.4108 of 2019(2) dt.25-01-2019 2/2 such the offence as alleged, is not grave. It is submitted that the petitioner has a clean antecedent and he is languishing in custody since 13.10.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dalsingsarai in connection with Ujiyarpur P.S. Case No. 175 of 2018.
