JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be Gotani of deceased and according to prosecution case, the informant got an information from the deceased that she was assaulted by petitioner and her husband on 01-08-2015 and after that, the informant came to the house of deceased and took her to hospital, where she got treated and after that, discharged from the hospital. Again, the informant got information on 09-08-2015 from the deceased about her condition and after that, when he reached at the in-laws house of deceased, he found the deceased in serious condition and while the deceased was being taken to hospital, she died on her way. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.5247 of 2016 (2) dt.12-02-2016 2/2 postmortem report of deceased does not corroborate the allegation because no injury was found on the person of the deceased and the doctor could not give any definite opinion regarding cause of death of the deceased.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Goraul P.S. Case No. 254 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali at Hajipur.
