JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2022 The learned counsel for the petitioner has submitted that during the pendency of the present writ petition, a fresh notice under Section 3 of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956') dated 28.12.2020 has been issued to the petitioner to which the petitioner has also filed a reply dated 11.01.2021, hence it is submitted that the same may be considered by the Circle Officer, Sadar Chapra and he be directed to take a final decision, in accordance with law.
Accordingly, the present writ petition stands disposed off with a direction to the Circle Officer, Sadar Chapra to
Patna High Court CWJC No.2405 of 2020(2) dt.20-07-2022 2/2 consider the objection/show cause reply filed by the petitioner, which is at Annexure-6 to the I.A. filed today and pass appropriate final order, in accordance with law. It is needless to state that till the final order is passed, status quo existing as on today shall be maintained. The writ petition stands disposed off on the aforesaid terms.
