The petitioner was removed from service as a Constable in the State Police Force owing to institution of a criminal case which has ultimately resulted in his acquittal and it is in this view of the matter that the petitioner appealed for reinstatement and which has been allowed under the order of the Superintendent of Police, Nalanda bearing Memo No.1819 dated 16.6.2011. However, while reinstating the petitioner the Superintendent of Police, Nalanda has not allowed the wages for the dismissal period i.e. 28.7.2007 to 6.6.2011 on the principle of 'no work no pay'.

Patna High Court CWJC No.434 of 2017 dt.17-11-2017 That the petitioner never chose to raise the issue of back wages for all the six years except to file the present writ petition, neither on merits nor on the delayed action I am persuaded to grant indulgence.

The writ petition is disposed of.
