JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2023 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Alamganj P.S. Case No. 58 of 2020 registered for the offences punishable under Sections 457, 380of the Indian Penal Code .
As per the FIR, petitioner and other co-accused persons committed theft in the house of the informant. It is submitted by the learned counsel for the petitioner that informant is not an eye witness of the occurrence. In fact informant is encroacher in the campus of the college against them several complaints were lodged by the petitioners
Patna High Court CR. MISC. No.3968 of 2023(2) dt.03-04-2023 2/2 and hence out of revenge, they have been falsely implicated in this case . FIR has been lodged aft er a delay of five days. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, -IV, Patna city in Alamganj P.S. Case No. 58 of 2020 subject to condition as laid down under Section 438(2) of the Cr.P.C.
