The present case was registered under Section-302 & other minor sections of the Indian Penal Code but after investigation, police submitted charge sheet under Section-304 & other minor sections of the Indian Penal Code. The allegation against the petitioner is that he gave one iron rod blow to the deceased causing injury to him.

Considering the aforesaid facts and circumstances as well as submission of the parties and also keeping in mind that the charge sheet has not been submitted u/S 302 of the Indian Penal Code, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
