JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 19-05-2017 Inter alia contending that there is encroachment over a public road in village Kesopur, District- Bhojpur and in spite of reports and observations made by the Executive Engineer as contained in Annexure 4 dated 13.2.2017, the encroachments are not being removed and are pending with the authorities and the authorities are not taking any action in the matter for removal of the encroachments, this writ petition is filed.
Petitioner may file a properly constituted petition under
Patna High Court CWJC No.5526 of 2017 dt.19-05-2017 2/2 the Public Land encroachment Act before the competent statutory authority and the competent statutory authority shall proceed to take action in accordance with the Statute, preferably within six months, and after hearing all concerned, pass appropriate orders for removal of the encroachment and decide the proceedings in accordance with law.
