JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 The learned Additional Chief Judicial Magistrate, Danapur, Patna has sent the explanation of concerned I.O vide letter no.217 dated 12.04.2019 , who stated in his explanation that injured Awadesh Yadav has sustained minor injury and got treated himself in a private clinic and that was the reason the injury report could not be prepared nor could be obtained. Perusal of case diary goes to show that the concerned I.O did not even record the statements of injured persons. Moreover, Para-3 of the case diary shows that allegation against petitioner is that he gave Garasa blow on the head of Awadhesh Yadav. The injury report of the Awadesh Yadav has not been brought on the record. The above stated fact clearly reflects the laxity of concerned I.O. Moreover, petitioner is in jail custody since 26.11.2018 and, therefore, considering the aforesaid facts
