The petitioner is languishing in custody since 20.09.2014 in a case registered for the offences punishable under Sections 341, 323, 447, 379, 427 and 307/34 of the Indian Penal Code. Subsequently, section 302 IPC was also added. It is alleged that the accused persons including the petitioner came to the field of the informant and assaulted the informant and others. Due to assault Md. Firoj became unconscious and was referred to PMCH where he succumbed to the injury.
It is submitted by learned counsel for the petitioner that the specific accusation of assault to the victim is
Patna High Court Cr.Misc. No.12141 of 2015 (02) dt.30-03-2015 2/2 against Md. Anwar, Md. Afsar and Md. Rinka with iron rod which proved fatal. It is further submitted that similarly situated accused Md. Islam, Md. Khursid, Md. Chunna and Md. Mikael alias Nikel alias Chhuna have been granted bail vide Cr. Misc. No. 18255 of 2014, co-accused Md. Naim and Md. Ibrahim have been granted bail vide Cr. Misc. No. 23328 of 2014 and 6500 of 2015. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 582 of 2013.
