JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2015 Petitioner is languishing in custody since 22.11.2014 in a case registered for the offences punishable under Sections 366, 506, 120B of the I.P.C.

Accusation is kidnapping the married daughter of the informant by Babiya Khatoon, Samua, Raish Miyan. It is alleged by the petitioner that when the victim returned this petitioner instigated her to marry with Raish Miyan.

It is submitted by learned counsel for the petitioner that 164 Cr.P.C statement of the victim reflects that thrust of accusation is against Raish Miyan and suspicion was raised against the petitioner since Raish Miyan was addressing someone on mobile as Sarpanch and petitioner is Sarpanch Jhanjhra Gram Panchayat.
