The petitioner is accused in connection with Musrigharari P.S. Case No. 93 of 2019, registered under Sections 120B and 302/34 of the Indian Penal Code. The accusation is that son of the informant used to do work with the petitioner and on 30.08.2019, in course of returning to the house, her son was left by petitioner in the way but her son did not return. When she made query about her son then she came to know that her son was got down from motorcycle at Kali Asthan. On next morning, she came to know that the dead body of a person was thrown causing cut injury at his neck. Later on, she came to know that Rajesh Kumar, Vijay
Patna High Court CR. MISC. No.1489 of 2020(2) dt.23-01-2020 2/2 Paswan and Ajay Paswan under conspiracy committed the murder of her son.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case mere on suspicion, as deceased, son of the informant, used to do the work with the petitioner and petitioner left her son at Kali Asthan. It is further submitted that petitioner has no criminal antecedent and is in custody since 05.11.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class-cum-Additional Munsif, Samastipur, in connection with Musrigharari P.S. Case No. 93 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
