JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he along with four other FIR named accused took the deceased whose dead body was recovered later on from a field. The informant claimed in his written report that petitioner and his associates had committed the murder of the deceased as petitioner had taken rupees two lacs from the deceased in the name of selling land.

Learned counsel for the petitioner submits that except suspicion, there is nothing against the petitioner and moreover, having similar allegation, co-accused, Arun Rai has already been granted privilege of bail by a co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.5454 of 2016 (2) dt.16-02-2016 2/2 No doubt, petitioner does carry criminal antecedent of similar nature but in the present case except the above stated circumstances, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 257 of 2014.
