JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Danapur P.S. Case No. 721 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 350 litres of liquor from a tempo. Learned counsel for the petitioner submits that the petitioner was a passenger in the tempo and as such was not knowing what was being carried in the tempo.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.2921 of 2022(2) dt.04-03-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court, Patna in connection with Danapur P.S.
