2. Petitioner seeks bail, in connection with Beldaur P.S. Case No. 142 of 2022, F.I.R. dated 09.07.2022 for the offences punishable under Sections 147,148,149,341,323,307 and 302 of the Indian Penal Code.
3. Allegation against the petitioner is that he alongwith other co-accused persons assaulted to the father of the informant by means of iron rod, lathi and other weapons, as a result of which he fell down and thereafter petitioner put a tractor upon the father of the informant due to which his father died.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the
Patna High Court CR. MISC. No.4290 of 2023(7) dt.11-09-2023 2/2 FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.
5. Vide order dated 03.07.2023, a report was called for with regard to the present status of the trial. Report of the learned Trial Court dated 27.07.2023 reveals that out of nine chargesheet witnesses, four witnesses have already been examined.
6. Learned counsel for the petitioner fairly submits that after the report of the learned Trial Court some more witnesses have been examined.
7. In view of the report of the learned Trial Court that the trial is at the verge of conclusion, hence, I am not inclined to enlarge the petitioner on bail in connection with Beldaur P.S. Case No. 142 of 2022 pending in the court of learned Judicial Magistrate-1st Class, Khagaria.
8. Prayer is refused.
9. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
