JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 26-06-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Petitioner who happens to be under custody since 11.01.2014 has been alleged along with Sharma Sahani, a co-accused who had already been granted bail by the learned lower court itself vide order dated 28.04.2014 (Annexure-2) dragged the victim Puja Kumari aged about 11 years in the dead of the night in order to commit rape, however, the girl escaped.

Taking into account the nature of the allegation inconsonance with the period of detention, petitioner, Bachha Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Ist Additional Sessions Judge, Chapra, Saran in connection with POSCO Case No.04/2015 arising out of Dariapur PS Case No. 86/2013, corresponding to S. Tr. No. 415/2014.
