JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 07-122015 on the accusation that one loaded country-made Katta was recovered from his conscious possession. It appears that earlier one case i.e. Khaira P.S. Case No. 140 of 2013 was lodged against the petitioner but the present case is first case of the Arms Act which has been lodged against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khaira P.S. Case No. 256 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Jamui. (Hemant Kumar Srivastava, J) A.K.V.
