The petitioners are in custody since 25.10.2014 and 19.10.2014 respectively in connection with Brahampura P.S. Case

Patna High Court Cr.Misc. No.14184 of 2015 (3) dt.28-05-2015 2 / 2 No. 208 of 2014, registered for the offences punishable under Sections 363, 365 of the I.P.C. Later on, Section 364(A) of the I.P.C. was also added.

Learned counsel for the petitioners submits that the petitioners are not named in the F.I.R. yet on the basis of suspicion, they have been taken into custody. Learned counsel further submits that other persons who were also arrested on suspicion and have given confessional statement have not named these petitioners. Furthermore, the petitioners have no any criminal antecedent and yet they have been languishing in jail for over seven months.

Considering the aforementioned submissions and period of custody and also the fact that the petitioners have no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 38 of 2015, arising out of Brahampura P.S. Case No. 208 of 2014.
