Learned counsel for the petitioner submits that the issue raised in the present writ application is no more res integra as this Court had occasion to decide the issue vide judgment dated 23.06.2017 passed in LPA No. 167 of 2016 (Avinash Kumar Chakerworty & others Vs. The State of Bihar & others).

In view of the judgment dated 23.06.2017 passed in LPA No. 167 of 2016 (Avinash Kumar Chakerworty & others Vs. The State of Bihar & others), this writ application is also
