It appears that at the time of dismissal of the appeal on the ground that nobody appeared on behalf of the appellant, the learned counsel, Mr. Ravindra Kumar Roy was present on behalf of the respondents.

The learned counsel for the petitioners submitted that this restoration application has been filed within the limitation period and copy was served on the learned counsel, Mr. Ravindra Kumar Roy but he refused to accept the same. Certificate to that effect has been given by the learned counsel for the petitioners. Since the restoration application has been filed within 30 days, this M.J.C. application is allowed. First Appeal No.753 of 1977 is restored to its original file.
