The petitioner is languishing in custody since 17.02.2015 in a case registered for the offences punishable under sections 326, 307 and 349 in connection with Nawada Town P.S. Case No.93 of 2015, pending before the learned Chief Judicial Magistrate, Nawada.
It is alleged that petitioner caused injury with razor on the neck of the informant within court premises while the informant was in police custody.
It is submitted by learned counsel for the petitioner that the accusation has been levelled since there was a dispute between the petitioner and the informant as the sister of the
Patna High Court Cr.Misc. No.13879 of 2015 (3) dt.02-07-2015 2/2 informant was married with the brother of the petitioner, who subsequently, died and there is no accusation of repeating the blow. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, this court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for bail on behalf of the petitioner is rejected.
