JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 03.08.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner being husband of the deceased is languishing in jail custody since 01.07.2013 and earlier his prayer for bail was rejected by a coordinate bench of this court but trial court has reported that up till now, only two prosecution witnesses could be examined.
Taking note of the aforesaid facts and circumstances as well as submissions of the parties, prayer for bail of the petitioner in connection with Sessions Trial no. 736/2014 arising out of Masaurhi P. S. case no. 136/2013 pending in the court of the Addl. Sessions Judge IV, Patna stands rejected.
Patna High Court Cr.Misc. No.16669 of 2015 (3) dt.03-08-2015 However, the learned trial court is directed to conclude the trial of the petitioner within nine months from the date of receipt/production of a copy of this order, failing which the petitioner shall be at liberty to renew his prayer for bail before the trial court itself.
