2. The petitioner seeks bail in connection with S.T. No. 307 of 2021 arising out of Sultanganj P.S. Case No. 217 of 2019 registered for the offence under Section 302/34 of the Indian Penal Code.

3. As per the prosecution case, one Ashok Yadav is said to be the main assailant of the deceased who has hit the deceased on his head with Khanti.

4. The petitioner is in jail since 15.9.2023.

5. Considering the fact that the petitioner is not the assailant of the deceased, this application is allowed.

6. Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.4686 of 2024(3) dt.21-03-2024 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ, 16, Bhagalpur in connection with S.T. No. 307 of 2021 / Sultanganj P.S. Case No. 217 of 2019.
