The petitioner being father of the husband of the victim is languishing in custody since 29.08.2015 in a case registered for the offences punishable under sections 498A, 304B/34 of the Indian Penal Code.
Accusation is of killing the daughter of the informant after five years of marriage and buried the dead body. It is submitted by learned counsel for the petitioner that informant is not an eye witness to the occurrence and there is no direct material collected during investigation. The thrust of accusation is against the husband of the victim, who is in custody. The petitioner claims to be separate from the husband of the victim since three years prior to the occurrence.

Thakur, learned APP for the State that though the informant is not an eye witness to the occurrence but, he came to know from the villagers that all in-laws family members killed the daughter of the informant and buried the dead body, but admits after going through the case diary that there is no direct evidence collected during investigation against the petitioner.
Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Alauli P.S. Case No.75/2014.
