JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.1.2015 in a case registered for the offences punishable under Sections 409,420,467,468,471 and 120B of the Indian Penal Code. It is alleged that the petitioner being Vikas Mitra allowed the benefits under Indira Awas scheme to the persons having cemented house without making physical verification. The applicants' forms were not properly filled up and the names of non deserving persons were included in the BPL List. It is submitted by the learned counsel for the petitioner that petitioner was working as Vikas Mitra who has no authority to sanction benefits under Indira Awas scheme. The verification of the beneficiaries has to be done by Panchayat Secretary and only

Patna High Court Cr.Misc. No.11318 of 2015 (2) dt.26-03-2015 2/2 on suspicion the accusation has been levelled against the petitioner.

Considering the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Baniapur P.S. Case No. 10 of 2014.
